More than ninety lawsuits have been filed by creators against AI companies for copyright infringement. Authors, musicians, visual artists, news publishers. The cases are framed as the defining fight over creative labor. They are not. The defining fight is quieter, less photogenic, and far more consequential.
The question that will determine whether human creators keep their jobs is not whether training on copyrighted work is infringement. It is whether the output of AI generation can be copyrighted at all.
The ruling
In Thaler v. Perlmutter, the D.C. Circuit Court of Appeals held that a work generated autonomously by an AI system cannot receive copyright protection. Copyright requires a human author. The Supreme Court declined to review the decision in March. The law, as it stands today, is clear on one end: if a machine made it without a human, nobody owns it.
The Atlantic published a piece this week arguing that this ruling, not the training data lawsuits, is the real structural protection for creative labor. The argument is elegant and slightly uncomfortable. It goes like this.
Entertainment companies are in the business of monetizing intellectual property. Studios license films for streaming, theatrical distribution, merchandising, franchising. Record labels license recordings for sampling, soundtracks, advertising. Publishers license across formats, languages, and adaptations. Copyright protection is the engine that makes the money run. Without it, anyone can copy, distribute, or adapt a work for free. The financial model collapses.
If AI-generated work cannot be copyrighted, it cannot be licensed. If it cannot be licensed, it cannot be monetized through the machinery that pays for everything. A studio that replaces its screenwriters, actors, and cinematographers with a prompt and a model produces output that anyone can legally copy the next morning. No exclusive streaming deal. No merchandising. No franchise. No moat.
The copyright wants a filmmaker. Not out of kindness. Out of economics.
The line nobody has drawn
The easy case is settled. A fully autonomous AI generation with no human input cannot be copyrighted. That was Thaler. The hard case has not been decided. How much human involvement is enough to make an AI-assisted work copyrightable?
The Copyright Office has suggested that human prompting alone should not be sufficient. Typing four words into a chat interface and accepting whatever the model returns is not authorship. But courts have not endorsed this position yet. And the line between "prompting" and "directing" is the line that matters most for AI filmmakers right now.
Consider two filmmakers using the same model on the same day.
The first types "cinematic shot of a woman walking in rain" and accepts the output. The second specifies motivated rim light from camera left separating the subject from a rain-slicked background, shallow depth of field with foreground bokeh from out-of-focus streetlights, the subject positioned in the left third of the frame walking toward camera right, warm practicals in the background at 2700K against cool blue ambient, visible breath in the air, 35mm anamorphic with subtle horizontal flares from the practicals. Then iterates. Changes one variable. Regenerates. Compares. Adjusts the motion prompt. Selects the take that carries the specific tension they wanted.
Both used AI. Both produced video. One exercised creative authorship across dozens of specific decisions. The other exercised none.
When courts eventually draw the line, the question will not be "did a human press the button?" It will be "did a human make the creative decisions that shaped the output?" And the vocabulary to describe those decisions, to document them, to demonstrate that a human mind was directing the result at every stage, is exactly the vocabulary that structured prompting builds.
The structural incentive
Netflix's production guidelines already warn creators not to use AI to generate "main characters, key visual elements, or fictional settings that are central to the story without written approval." Hachette pulled a book after allegations of AI writing. Studios are not doing this because they care about creative labor in the abstract. They are protecting the copyrightability of their output.
A $200 million film that cannot be copyrighted is a $200 million donation to the public domain. Every competitor can redistribute it. Every streamer can host it. Every merchandise operation can print from it. The ROI calculation breaks. The greenlight meeting never happens. The budget stays in the account.
This structural incentive operates independently of cultural sentiment, public opinion, or ethical argument. It does not require audiences to prefer human-made work. It does not require unions to negotiate protections. It does not require governments to regulate. It requires only that copyright law continues to mean what it has meant since 1790: a human made this.
Sora's collapse demonstrated the economics from the other direction. OpenAI announced a "landmark" Disney licensing deal. Months later, Sora was dead, Disney pulled its billion-dollar stake, and the tool generated $2.1 million lifetime revenue against operational costs that dwarfed it. The Atlantic's authors ask: why pour billions into a generation tool that creates content nobody can turn into commercially viable IP?
The vocabulary is the evidence
Here is where it gets interesting.
If copyrightability turns on the degree of human creative involvement, then the structured cinematographic decisions this series documents are not just craft. They are evidence. A filmmaker who selects a specific lens behavior, specifies lighting direction and color temperature, chooses compositional placement, describes material texture and atmospheric conditions, selects a model based on its temperament for the specific shot, iterates across takes changing one variable per pass, and assembles the results through editorial judgment, has produced a documented chain of human creative decisions at every stage of the pipeline.
That chain is the authorship copyright looks for.
A filmmaker who types four words into a living room television and accepts whatever the model volunteers has produced a chain of zero creative decisions. The model made them all. The model is not a person. The output has no author.
The absorption trajectory is also a copyright gradient. From structured prompting through chatbots through editing timelines through agents through productivity suites through televisions. Each step that removed human vocabulary from the process also removed human authorship from the output. Each step that made generation more casual made the result less copyrightable.
The tools that preserved creative decision-making preserved copyrightability. The tools that replaced creative decision-making with defaults and convenience produced legally unprotected output at massive scale.
The uncomfortable middle
Copyright cannot save everything. Stock photography was already structurally vulnerable before copyrightability became a question. If a company can generate an adequate image for a website, the commercial photographer loses the commission regardless of whether the generated image is copyrightable. The argument applies most forcefully to the industries where large companies serve as intermediaries between creators and consumers: film, television, music, publishing. The industries where IP is the product, not a byproduct.
And the line, wherever courts draw it, will be fought over. The businesses that profit most from replacing human labor will push to define "human authorship" as loosely as possible. A few keystrokes. A light editorial pass. The thinnest possible veneer of human involvement stretched over a fully generated work. If that argument wins, the structural protection evaporates.
This is why documentation matters. This is why structured prompting that specifies, iterates, and records creative decisions is not just better filmmaking. It is a legal record of human authorship that survives the courtroom.

Not because the law is sentimental about artists. Because the entertainment industry needs IP it can license, and IP requires an author, and an author requires creative decisions, and creative decisions require vocabulary.
The law does not care about your feelings regarding AI. The law cares about whether a human being exercised creative judgment in shaping the work. The more specific your vocabulary, the more documented your decisions, the more iterative your process, the stronger your claim to authorship.
Vocabulary, articulation, knowing what you want. Turns out the law was asking the same question all along.
